With us entering in the year 2025, it cannot be denied that artificial intelligence has become a great part of our lives. It not only dominates areas related to trade, business, industries but also basic day to day activities. Artificial intelligence is set to take over the world and is gradually stepping in law too. Intellectual Property Laws is one of the sectors of law in which artificial intelligence is flourishing. IP laws have already provided protection for AI- related innovations such as algorithms, software and databases.

It is no secret that artificial intelligence can be beneficial in various ways but at the same time can also be disastrous. Through this article we will try to understand the impact of Artificial Intelligence on Intellectual Property Law and how with proper care and precaution both the world’s can go hand in hand providing nothing but success.

What are Intellectual Property Rights?

“Intellectual Property” is a generic term that probably came into regular use in the 20th century. Intellectual Property Rights are the legal protections given to people over their creative endeavours and usually gives the creator an exclusive right over the use of his/her creation or discovery for a certain period of time. In simple words, it literally means, the things that originate from human brain. Intellectual Property includes;

(a) Patents:- Patent refers to a grant of some privilege, property or authority made by the government or the sovereign of the country to one or more individuals. The instrument by which such grant is made is known as ‘Patent’.

(b) Trademarks:- A trademark is a visual symbol in the form of a word, device or a label applied to articles of commerce with a view to indicate to the purchasing public that they are the goods manufactured otherwise dealt by a particular person as distinguished from similar goods manufactured or dealt by other persons.

(c) Copyright:- The copyright is a unique kind of intellectual property. The authors, composers, artists, designers etc. are entitled to enjoy the exclusive rights to subject matter of copyright. The object of copyright law is to protect the author of copyright work from an unlawful reproduction or exploitation of his work by others.

The knowledge of Intellectual Property Law is essential to all those people who are involved in business, law and industrial activity. The World Intellectual Property Organisation ( WIPO) has been established to promote the use and protection of works of the human spirit. WIPO plays an important role in enhancing the quality and enjoyment of life, as well as creating real wealth for nations.

What is Artificial Intelligence?

Artificial intelligence in it’s broadest sense means, machines doing complex tasks that historically only humans were able to perform, such as reasoning, making decisions or solving problems. Artificial intelligence was introduced in 1950s and has grown rapidly over the time. Today a lot of of technologies. Today Ai is working wonders and the future of Ai is something beyond a man’s imagination. Here are a few types of artificial intelligence :-

(a) Reactive machines:- These are the most basic type of artificial intelligence. Machines built in this way are not very complex and just react to what is offered before them. They cannot perform outside their limited context.

(b) Limited Memory Machines:- These are machines with limited background context and limited understanding of past events. They provide more efficient reactions than the reactive machines. For example, self driving cars use a form of limited memory to observe approaching vehicles, make turns and adjust speed.

Impact of Ai on IP laws:- A Boon or A Curse?

There is no doubt that Artificial intelligence is here to stay and its use will help in reshaping various law related aspects in the future. Artificial Intelligence has enhanced the working of intellectual property rights by numerous angles. It helps in analysing data. It makes sure that that no repetitive data is being registered and that only genuine and real innovations stand a chance. It has increased efficiency in managing portfolio, improved accuracy in identifying potential infringement. It has streamlined trademark registration process. It also reduces costs through automation and all this while minimizing human error.

However, as they say every coin has two sides. Likewise, impact of artificial intelligence also has it’s pros and cons. Considering the benefits of Ai it has done nothing but enhance the use of Intellectual property rights. Artificial intelligence faces various challenges of authority and ownership. Most copyright laws require human authorship, making Ai- created difficult to protect. Some of the patent offices reject where Ai is listed as an inventor, raising questions about attribution. Fair use laws are unclear on large scale Ai training. Ai generated trademarks sometimes unintentionally infringes existing trademarks.

The question that arises in front of us through the above discussion is that whether artificial intelligence acts as a boon or a curse for Intellectual property laws. We saw both the aspects of the impact of Ai on intellectual property rights. Artificial intelligence can be considered both as a blessing as well as a curse. It will help the world grow economically, socially as well as help boost the industrial and business activities in the world, but it will at the same time cause unemployment, poverty and unrealistic work expectations from human mind. It will in a way handicap the human brain and body making it difficult to come up with new ideas and innovations as human brain by that time will already be used to spoon feeding and ready served platters. It will cause rust to the human brain as it will no longer be able easily perform activities it used to before because of readymade solutions provided by artificial intelligence.

Artificial intelligence if used cautiously with some precautions will beautifully go hand in hand with Intellectual property laws and together it will cause wonders for the world. Many international and national organizations are recognising the value of artificial intelligence and incorporating in their systems. There’s no denying that artificial intelligence is the future.
