PATENT FILING IN TURKEY

The Turkish Patent Office, officially known as the Turkish Patent Institute, was established on June 24, 1994 in Ankara. Turkey joined WIPO in 1976. Over the years, the Turkish Patent Office has implemented significant reforms to bring its policies in line with global patent systems.

One of the major changes in the updated Turkish Patent Law is the removal of the earlier provision that allowed a seven-year short-term patent without substantive examination. Under the revised law, all applicants must request substantive examination, and failure to do so results in the application being deemed withdrawn.

Filing to Grant Procedure

STEP 1 : FILING

A patent can be filed in Turkey as any of the following formats in Turkish translation:

  • Paris Convention based national entry.

  • PCT National Phase based national entry.

STEP 2 : PUBLICATION
  • Publication of Turkish patents is done within 18 months of the priority date.

STEP 3 : EXAMINATION
  • Request for examination has to be made within 6 months from the publication date.

STEP 4 : PROSECUTION
  • Response to the Examination Report has to be submitted within 6 months together with a request for second examination.

STEP 5 : GRANT
  • Annuity for the 2nd year onwards is to be paid after grant of the patent. Protection of the patent is for 20 years from the International Filing Date.
