National Phase Filing

The National Phase Application is an application filed for obtaining a grant of patents in different countries simultaneously based on a single International/PCT application that is filed within 12 months from the priority date (or filed directly). National phase filings are done as per the PCT (Patent Cooperation Treaty) that is administered by WIPO (World Intellectual Property Organization), wherein there are 153 countries that are the members of the PCT, and therefore an Applicant can nationalize its/his/her application in any or a combination of the 152 countries using the PCT route. PCT route enables an Applicant to seek patent protection for an invention in a large number of countries simultaneously by filing a single international patent application instead of filing several separate national or regional patent applications (through the Paris Convention route).



Steps for Filing a PCT National Phase Application


Each national phase application (except for some exceptions in few countries) must be submitted within 30/31 (depending on the country) months from the Priority Date. As each country has its own formality requirements such as translation, submission of PoA, assignment deed, etc. It is important to ensure that the action for national phase filing is initiated in a timely manner for efficient completion of the filings in different countries.
