PATENT FILING IN UKRAINE

Ukraine is the second largest contiguous country on the European continent, after the Russian Federation. Ukraine joined WIPO in 1970. Ukrpatent is the only institution in Ukraine authorized to deal with Intellectual Property (IP) matters. On 16th May 2008, Ukraine became a member of the World Trade Organization, as a result of which it is has made the amendments to its patent laws to make its patent filing process convenient and efficient at global platform. The industrial sectors that account for the vast majority of commercialised patents in Ukraine are Chemicals, Biotechnology and Electronics.

Filing to Grant Procedure

STEP 1 : FILING

A patent application can be filed in Ukraine as any of the following applications in Ukrainian:

  • Paris Convention based national entry.

  • PCT National Phase based national entry.

STEP 2 : PUBLICATION

Publication of Ukrainian patents takes place within 18 months of priority date.

STEP 3 : EXAMINATION

Request for examination has to be made within 36 months from the international filing date.

STEP 4 : GRANT

Payment of annuities is not stipulated for the pending patent applications in Ukraine. The first post grant annuities are paid within 4 months from publication of the patent. All next annuities are counted starting from the filing date and are paid before a beginning of the next year. Protection of the Patent is for 20 years from the International Filing Date.
