PATENT FILING IN POLAND
With a population of around 39 million, Poland is a major Central-Eastern European country with one of the region’s most dynamic economies—currently ranked as the 6th largest in Europe. Poland joined WIPO in 1975 and became a member of the European Union in 2004. As Poland accepts patent filings through both the European Patent Office (EPO) and the PCT route, applicants have the flexibility to choose the most suitable method.
Patent filings in Poland require submission of application documents in Polish. While applicants may submit applications themselves, expert translation is strongly recommended to avoid delays caused by translation-related errors. A patent can be filed in Poland as any of the following formats in Polish translation:

Paris Convention based national entry.

PCT National Phase based national entry.

Publication of Polish patents is done within 18 months of the priority date.

In Poland, examination of a patent application starts automatically at filing.

Response to the Examination Report has to be submitted within 3 months from the date of the First Examination Report (FER).

First annuity must be paid within 3 months of grant of the patent. Thereafter, annuities must be paid yearly. Protection of the patent is for 20 years from the International Filing Date.
