PATENT FILING IN DENMARK

Denmark is a sovereign state in Northern Europe, located southwest of Sweden, south of Norway, and bordered to the south by Germany. The Patent Office of Denmark is the Danish Patent and Trademark Office (DKPTO). Denmark joined WIPO in 1970.

Filing to Grant Procedure

STEP 1 : FILING

A patent can be filed in Denmark as any of the following formats:

  • Paris Convention based national entry.

  • PCT National Phase based national entry.

STEP 2 : PUBLICATION
  • Publication of Denmark patents is done within 18 months of the priority date.

STEP 3 : EXAMINATION
  • Request for examination has to be made at the time of filing.

STEP 4 : GRANT
  • Annuity for the 1st to 3rd year has to be paid by the end of the 2nd year. Annuity for the 4th year onwards is to be paid after grant of the Patent. Protection of the Patent is for 20 years from the International Filing Date.
